I Refused the Breath Test But Do Not Have a Request for Hearing Form

If you refused a breath test, you have 14 days to request a hearing. If the officer makes a mistake and fails to provide you with a request for hearing form, you might spend days or even weeks fighting to correct this error.

YOU NEED THE FORM TO REQUEST THE HEARING! So what can you do?

DO NOT ALLOW THE 14 DAYS TO LAPSE AFTER YOU HAVE RECEIVED A NOTICE OF REFUSAL!

You can fudge the request for hearing to ensure that you meet the 14 day requirement by filing out a blank Request for Hearing form available here. This is the form that my office uses on a regular basis. (HINT: If you don't want me getting copies, make sure to scratch out my address!) And just FYI, if you use this form and I get copies of correspondence from the Secretary of State, know and understand that I am not your attorney unless or until you actually retain me to represent you!
