OWI PUSH-OFF Update: Ordinary Citizens are Winning the War!
On February 11, 2005, an order was entered against the City of Belleville, Michigan, in the 34th District Court, settling an OWI Push Off case. Although monetary damages were only a nominal $250.00, our firm was able to succeed in compelling the City of Belleville Police Department to pay the vehicle owner damages after we compelled the police to return the vehicle.
This firmly establishes a precedent showing that Prosecuting Attorney Kym Worthy's vehicle seizure program is flawed, misguided and overly zealous. Promising quick money to local police departments (the sole motivation for the policy), many Wayne County police agencies signed on to this seizure program. So far, it's only costing them money.
Although Michigan laws permit vehicle forfeiture and vehicle seizures when certain drunk driving offenses are committed, the Wayne County Prosecutor's Office and local police departments must follow the law. If they fail to follow the law, as they have been since October 12, 2004, our firm is prepared to challenge the unconstitutional and unlawful seizures.
