RZ was charged with OUIL
At 2:00 a.m. as the bar parking lot was emptying, a local police officer was responding to a malicious destruction of property charge. As the police officer drove through the parking lot, the officer nearly collided with a motorist backing out of his parking lot. Reacting to the near-miss, the police officer decided to investigate whether the driver had been drinking. After performing field sobriety tests and a preliminary breath test, RZ was arrested. A DataMaster was later employed to perform a evidentiary breath test, and the client was charged with OUIL.

After interviewing the client, our firm decided that the police officer was likely speeding through the parking lot and had maliciously investigated the driver without probable cause. After filing demands for access to the squad car videotapes to establish that fact, the videos were not produced. As a result, all charges were dropped against the client.
