Oakland County Drunk Driving
It is difficult to generalize about Oakland County because so many of the courts treat drunk driving differently. Generally, there is no period of incarceration for first time offenders, but Oakland County contains at least one notable exception to that rule where first time offenders almost always receive a few days in jail.
Oakland County also has a diverse array of innovative forms of punishment. In Troy, a convicted driver may be required to place a bumper sticker on his or her automobile, while in Rochester, a person convicted of drunk driving might be required to visit the county morgue.
One interesting Oakland County innovation includes "Sobriety Court." Sobriety Court originated in the 52-1 District Court in Novi. It is a program designed to help repeat offenders stop drinking and to prevent recidivism. The program is an extremely intense one, requiring constant monitoring, group support, and substance abuse therapy. In connection with the program, the defendant gives up numerous rights in a contractual agreement with the court. Sobriety Court is a program targeted and designed to treat the worst offenders. Contrary to the Novi model, the program was later adopted in a bastardized form by the Waterford District Court, where the program is employed across the board against most first time offenders without regard to whether the driver has a substance abuse problem.
