According to the Prosecuting Attorneys Association of Michigan (PAAM), there were 53,166 drunk driving convictions in Michigan, (including 2nd and 3rd offenses) in 2002. There were 23,939 convictions to OUIL, 29,227 convictions to Impaired Driving, and 145 trial acquittals. Another 1,366 charges were reduced to non-alcohol related charges. With Michigan's new 0.08 law taking effect on September 30, 2003, the number of arrests and convictions will almost surely increase.
A person accused of a first time offense for drunk driving in Michigan faces a maximum of 93 days in jail, community service for not more than 360 hours, and a fine of not less than $100 or more than $500, plus court costs. Additionally, the secretary of state will suspend your license for 30 days, with an additional 150 days restricted driving privileges. Finally, the Michigan secretary of state will now impose an additional "driver's responsibility fee" in the amount of $1,000 a year for two years.
Penalties and driving sanctions increase and become more severe for repeat offenders. Repeat offenders face imprisonment and revocation of driving privileges.
In Michigan, because a person accused of drunk driving faces incarceration, you are afforded the right to have an attorney and the right to a jury trial. We feel that you should take advantage of these rights, regardless of whether a particular judge or prosecutor is willing to agree not to recommend jail or accept a plea to a supposedly less serious offense. There are serious consequences to a Michigan drunk driving conviction--irrespective of whether the conviction is to Operating While Intoxicated or the less serious offense of Operating While Visibly Impaired.
